Description
JOB SUMMARY: Acts as the legal advisor to senior management. Analyzes, advises, and handles legal issues arising in all external risk areas. Serves as Privacy Officer for the organization.
This position is a Safety Sensitive Position. The essential functions, physical demands, and mental competencies of this job require the employee maintain the ability to work in a constant state of alertness in a safe manner.
Requirements
EDUCATION, CERTIFICATION, LICENSURE, REGISTRATION:
1. Juris Doctor degree from accredited law school.
2. Valid law Arkansas Bar Association license.
3. 8+ years practice with a corporate law firm or comparable work experience considered that demonstrates in-depth experience in relevant aspects of health care law and clinical operations.
4. In depth knowledge of legislative, regulatory, and judicial issues that affect the healthcare community on state and federal levels, required.
5. Broad experience with corporate governance issues and corporate law.
6. Strong negotiating skills with both legal and financial/commercial issues
EXPERIENCE, KNOWLEDGE, SKILLS and ABILITIES:
1. Excellent skills in communicating clearly and effectively in English, including writing clear and concise documents.
2. Knowledge of statutes, rules and regulations pertaining to businesses.
3. Proficient understanding of business sensitivities and confidentiality.
4. Proficiency in Microsoft Office Word, Excel and Outlook.
5. Must be flexible, proactive, highly motivated, resourceful, professional and efficient.
6. Ability to respond to emergency situations at any time and to work unusual hours as required.
7. Ability to work independently or with little supervision.
8. Ability to plan and supervise the work of subordinates.
9. Ability to develop and maintain effective working relationships with members of the department and external entities and bodies.
10. Ability to exercise sound, independent judgment in carrying out functions of the position.
11. Experience in OSHA and ADH regulatory requirements.
Summary
SPECIFIC JOB DUTIES AND RESPONSIBILITIES:
1. Provides counsel on medical staff matters, including bylaws, medical staff corrective action, peer review, and disciplinary actions of medical staff.
2. Provides counsel for legal aspects of patient care with significant medical-legal dimensions, including informed consent, medical records/privacy matters, and patients’ rights concerns.
3. Provides counsel on data protection and cybersecurity.
4. Analyzes, troubleshoots, and measures performance for processes affecting Health Information.
5. Assumes responsibility for organization’s involvement in litigation. Determine when outside
counsel should be consulted and manages the process.
6. Responsible for HIPAA compliance and confidentiality of patient information, as well as accurate and timely release of patient information within state and Federal guidelines.
7. Provides oversight for the implementation and maintenance of the Health Information Management program, including release of information, HIPAA privacy and security.
8. Keeps current with proposed federal and state statutes and regulatory requirements which may impact the organization’s Health Information.
9. Investigates reported HIPAA concerns.
10. Researches and anticipates unique legal issues that could impact the organization; estimates risk(s) strategically.
11. Identifies proactive solutions that will eliminate or mitigate risks.
12. Provides training to CARTI team members regarding legal topics.
13. Bases decision making process on ethics and integrity.
14. Creates associations of trust and respect with key stakeholders.
15. Maintains keen awareness of legal, regulatory and legislative changes.
