Job Responsibilities About Our Agency The South Carolina Department of Disabilities and Special Needs (DDSN) is the state agency that plans, develops, coordinates, and funds services for South Carolinians with the severe, lifelong disabilities of: intellectual disability and related disabilities autism spectrum disorder traumatic brain injury spinal cord injury and similar disability Job Responsibilities Under the limited supervision of the State Director performs assigned duties with a great degree of independence and discretion. Functions as General Counsel for the SC Department of Disabilities and Special Needs (DDSN). Represents DDSN in both federal and state courts and before administrative bodies with a great degree of independence and discretion. Provides legal advice and assistance to agency personnel on complex legal matters. Prepares and issues legal opinions to key DDSN staff. Provides legal assistance to DDSN staff for contracts, leases and property transfers. Serves as liaison to other state/federal agencies on legal matters. Coordinates and confers with other agencies (Attorney General's Office, SLED, DHHS, Solicitors and Public Defenders). Consults with legal departments of other agencies for information, as needed. Coordinates and monitors cases against DDSN assigned to outside counsel. Confers on tort liability insurance renewals. Reviews employee grievance appeals and discrimination complaints. Represents DDSN in employee mediations and in grievance appeals. Represents DDSN in family court and probate court judicial admission proceedings. Represents DDSN in other judicial forums. Researches and prepares memorandum and legal briefs as required. Reviews evaluations for criminal competency to stand trial evaluations and post-conviction relief cases and works with the courts and attorneys on obtaining required evaluations. Prepares and presents training as required to Judges, attorneys, DDSN personnel, and DDSN Commission on laws, policies and procedures pertaining to DDSN. Responsible for the supervision of all attorneys and other legal staff within DDSN's Legal department. Manages the workload of the Legal Department staff and evaluates performance to ensure quality legal service. Ensures all outside employment requests are reviewed and processed in accordance to the DDSN directive. Responsible for the oversight of the Risk Management Division. Ensures the Risk Management Director and their staff reviews and manages all Abuse, Neglect, and Exploitation (ANE) cases, all Critical Incidents, and that any outcomes of disciplinary actions are coordinated with Human Resources. Reviews any possible litigation with the Risk Management Director. Responsible for the oversight of the Information Security Office. Ensures the Chief Information Security Officer (CISO) executes the agency's enterprise Information Security (INFOSEC) Program and that compliance is maintained with the established policies and procedures by the Department of Administration, as well as all applicable Federal and State laws. Reviews any breaches or significant events with the CISO and Chief Information Officer (CIO). Manages the oversight of all Freedom of Information Act (FOIA) requests, and ensures that all inquiries are responded to in a timely manner. Serves on select SC Bar committees and state-wide Task forces. Performs additional duties as assigned. Preferred Qualifications Admitted to the US District Court for the District of SC. Experience as a practicing attorney, to include SC Family Court, Probate Court, and administrative hearings. Knowledge and experience with Americans with Disabilities Act (ADA). Knowledge and experience with Freedom of Information Act (FOIA). Familiarity with Roberts Rules of Order.
